La Cour europ&eacute;enne des droits de l&rsquo;homme (CEDH) a toujours explicitement formul&eacute; le droit des &Eacute;tats &agrave; contr&ocirc;ler les entr&eacute;es sur leur territoire, en insistant sur le fait que la d&eacute;tention ne peut &ecirc;tre consid&eacute;r&eacute;e comme arbitraire tant qu&rsquo;elle sert un int&eacute;r&ecirc;t public l&eacute;gitime. Les concepts de proportionnalit&eacute; et de n&eacute;cessit&eacute; semblent &ecirc;tre les deux contrepoids au concept de l&rsquo;arbitraire, et le Comit&eacute; des droits de l&rsquo;homme des nations Unies sugg&egrave;re qu&rsquo;ils occupent une position centrale dans les situations de privation de la libert&eacute;. Il ne suffit pas que la d&eacute;tention serve un objectif politique; si elle ne passe pas le test de la proportionnalit&eacute; et de la n&eacute;cessit&eacute;, elle ne peut &ecirc;tre justifi&eacute;e et elle devient alors &laquo;arbitraire&raquo;. En effet, d&rsquo;aucuns affirment que dans le cas des demandeurs d&rsquo;asile, la d&eacute;tention ne repose sur aucune justification juridique sauf dans des circonstances exceptionnelles telles que les risques pos&eacute;s &agrave; la s&eacute;curit&eacute; nationale ou &agrave; l&rsquo;ordre public. N&eacute;anmoins, les &Eacute;tats continuent de d&eacute;tenir les migrants sans tenir compte de la proportionnalit&eacute; ni de la n&eacute;cessit&eacute;. &Eacute;troitement li&eacute;es &agrave; ces deux notions, les concepts d&rsquo;&eacute;quit&eacute;, de justice et de pr&eacute;visibilit&eacute; sont &eacute;galement cruciaux pour comprendre l&rsquo;arbitraire, et toute personne examinant si une d&eacute;tention particuli&egrave;re est arbitraire devrait les garder &agrave; l&rsquo;esprit.<\/p>\n<p>Dans le contexte d&rsquo;une proc&eacute;dure d&rsquo;expulsion, selon la CEDH, la d&eacute;tention est uniquement justifiable aussi longtemps que la proc&eacute;dure est en cours et &laquo;si telle proc&eacute;dure n&rsquo;est pas men&eacute;e avec la diligence requise, la d&eacute;tention ne sera plus permissible&raquo;.<a href=\"#_edn1\" name=\"_ednref1\" title=\"\">[1]<\/a> M&ecirc;me si les &Eacute;tats affirment le contraire, la d&eacute;tention des personnes en attente d&rsquo;&ecirc;tre expuls&eacute;es doit &ecirc;tre &agrave; la fois proportionnelle et n&eacute;cessaire; que le d&eacute;tenu en question soit soumis &agrave; un ordre d&rsquo;expulsion ne constitue pas en soi une justification suffisante.<\/p>\n<p>Enfin, les circonstances individuelles de chaque cas particulier doivent toujours &ecirc;tre prises en consid&eacute;ration. Il est crucial d&rsquo;&eacute;viter une approche unique et indiff&eacute;renci&eacute;e.
